3D Model and Asset Commission Contract for VtubingParties:
This Agreement ("Contract") is entered into between the Artist/3D Modeler ("Artist") and the Commissioner ("Commissioner") for the creation of 3D models and assets for Vtubing.Project Description:
The Artist agrees to create original 3D models and assets exclusively for the Commissioner's use in Vtubing, with no reuse for any other purpose, unless otherwise stated in specific terms.Payment Terms:
1. The Commissioner agrees to pay 50% of the total agreed-upon amount as a non-refundable upfront payment upon the signing of this contract.
2. The remaining 50% is due upon completion and delivery of the final artwork.Commercial Use Rights:
The Commissioner is granted the right to commercially use the 3D models and assets for Vtubing and Merchandising, unless otherwise specified in specific terms.Material Costs:
In the event that external 3D assets are used, the Commissioner agrees to cover any associated material costs. These external assets are not to be used for any other purpose without proper purchase from the original creators.Termination Agreement:1. Termination Steps:
a. Conceptualization Phase: 25% refund of the total agreed-upon amount.
b. Modeling Phase: 15% refund of the total agreed-upon amount.
c. Texturing/Detailing Phase: 10% refund of the total agreed-upon amount.
d. Finalization Phase: No refund.
2. Material Costs:
a. Material costs are non-refundable at any stage of the project.
3. Mutual Agreement:
Both parties may mutually terminate this contract at any stage by providing written consent. In such cases, the refund policy outlined above will apply.Delivery:
The final 3D models and assets will be delivered to the Commissioner in a mutually agreed-upon format and platform.Timeline:
The Artist will provide the Commissioner with regular updates on the progress of the project and will adhere to the agreed-upon timeline.Confidentiality:
Both parties agree to keep all aspects of this project confidential, including but not limited to, project details, concepts, and work-in-progress materials.Governing Law:
This Contract is governed by the laws of the state of Texas, and any disputes arising under or in connection with it shall be resolved in accordance with those laws.Signatures:
